Introduction

Welcome to NestroHub. These Terms & Conditions (“Terms”) govern your access to and use of the NestroHub website, property marketplace, land marketplace, professional directory, supplier and materials features, AI-powered services and related products and services.

By accessing or using NestroHub, you agree to these Terms. If you do not agree, you should not use the services.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements to create an account or use transactional marketplace functionality.

You agree to provide accurate, current and complete information and to use NestroHub in accordance with applicable law and these Terms.

User accounts

Registered users may publish listings, maintain professional or supplier profiles, manage enquiries, access dashboards and use available premium services.

• You are responsible for safeguarding your login credentials.
• You are responsible for activity conducted through your account.
• You must keep account information reasonably current.
• You must notify NestroHub if you reasonably believe your account has been compromised.
• You may not impersonate another person or organisation.

NestroHub's marketplace role

Users remain responsible for appropriate due diligence and independently verifying ownership, authority, title, approvals, condition, specifications, professional credentials, pricing and contractual terms before entering a transaction.

Property and land listings

When publishing a property or land listing, you represent that you are authorised to publish it and that the information provided is not knowingly false, misleading or unlawful.

• Descriptions, prices, availability and material facts should be accurate and reasonably current.
• Images, videos and media must be owned by you or appropriately licensed.
• You must not knowingly advertise property you have no authority to offer.
• You remain responsible for laws, permissions and disclosure obligations applying to your listing or transaction.

NestroHub may remove, restrict, expire or request changes to content that appears misleading, duplicated, unlawful, unsafe or inconsistent with platform requirements.

Professionals, agents and suppliers

Professionals, agents, contractors, consultants, suppliers and businesses are responsible for the accuracy of their profiles, qualifications, experience, licences, registrations, product information, availability and commercial representations.

Directory inclusion does not by itself constitute endorsement, certification or a guarantee by NestroHub. Users should independently assess a provider before appointing, purchasing from or paying that provider.

Enquiries, leads and communications

When you submit an enquiry or request to connect with another marketplace participant, relevant information may be delivered to that participant so they can respond.

Recipients must use enquiry information responsibly and in accordance with applicable privacy, marketing and communications requirements. Spam, harassment and unauthorised harvesting or resale of contact information are prohibited.

User content

You remain responsible for content you submit, including text, photographs, videos, reviews, logos, documents and listing information, and represent that you have the rights necessary to submit it.

By submitting content for publication, you grant NestroHub a non-exclusive licence to host, store, reproduce, format, display and distribute that content as reasonably necessary to operate, promote and improve the relevant marketplace service. This does not transfer ownership of your content to NestroHub.

Reviews and ratings

Reviews should reflect genuine experiences and must not contain knowingly false information, unlawful material, threats, harassment or undisclosed manipulation.

NestroHub may moderate or remove reviews where reasonably necessary to enforce platform rules or respond to legal concerns. A review is not necessarily a verified transaction unless expressly identified as such.

Prohibited conduct

You must not misuse NestroHub. Prohibited activity includes:

• Fraudulent, deceptive or materially misleading listings or profiles.
• Impersonation.
• Malicious code or unauthorised access attempts.
• Unauthorised scraping or systematic data extraction.
• Harassment, threats or unlawful discrimination.
• Infringement of intellectual-property or privacy rights.
• Manipulation of reviews, leads, rankings, advertising or marketplace functionality.
• Use of the platform for unlawful activity.

Verification and marketplace trust

NestroHub may provide identity, contact, business, listing or professional-verification features. A verification indicator means only that the checks described for that feature were completed at the relevant time. It is not a guarantee of identity, ownership, qualifications, future conduct, transaction quality or legal compliance.

Paid and premium services

NestroHub may offer featured or boosted listings, advertising packages, professional memberships and premium platform functionality. Pricing, duration, placement, included features and service-specific conditions displayed at purchase form part of these Terms.

Purchasing promotion or premium placement does not guarantee enquiries, leads, sales, traffic, rankings or transaction outcomes.

Payments, billing and refunds

Where payment is required, you agree to provide accurate billing information and pay the charges displayed for the selected service. Third-party payment-provider terms may also apply.

Unless different refund terms are expressly presented for a particular service or a refund is required by applicable law, payments for activated or delivered digital marketplace services are generally non-refundable.

Failed, reversed, disputed or fraudulent payments may result in suspension of the associated paid service while the matter is reviewed.

AI-powered services and tools

NestroHub may provide AI-powered search, recommendations, conversational assistance, summaries, market information or other automated tools. AI-generated output may be incomplete or inaccurate.

NestroHub intellectual property

NestroHub's branding, software, interfaces, page designs, databases, platform features and original content are protected by applicable intellectual-property laws. Except where permitted by law or expressly authorised, protected NestroHub materials may not be copied, reproduced, modified, sold or commercially exploited.

Third-party trademarks and content remain the property of their respective owners.

Third-party services and links

NestroHub may integrate or link to services operated by third parties, including maps, payments, communications, analytics and external websites. Those services operate under their own terms and privacy practices.

NestroHub is not responsible for the independent operation, availability or content of third-party services except to the extent responsibility cannot lawfully be excluded.

Privacy and personal information

Our handling of personal information is described in the NestroHub Privacy & Data Protection Policy. Marketplace users receiving another person's information through a lead, enquiry or transaction are also responsible for handling it lawfully.

Content moderation and enforcement

NestroHub may review, restrict, reject, remove, unpublish or expire content where reasonably necessary to operate the platform, enforce these Terms, address complaints, protect users, prevent abuse or respond to legal requirements.

Moderation does not mean NestroHub has independently verified every item of user-generated content.

Marketplace disclaimers

NestroHub aims to provide a useful marketplace, but user-generated information may contain errors or become outdated. Unless expressly stated otherwise, NestroHub does not independently guarantee property ownership, title, boundaries, planning status, legal status, listing accuracy, professional qualifications, supplier performance, product quality or transaction outcomes.

Users should obtain appropriate legal, financial, technical, valuation and other professional advice where relevant.

Limitation of liability

To the fullest extent permitted by applicable law, NestroHub will not be liable for indirect, incidental, special or consequential loss arising from use of, or inability to use, the platform, user-generated content, AI tools, third-party services or transactions between marketplace participants.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

Responsibility for misuse

To the extent permitted by applicable law, you are responsible for claims, losses or reasonable costs arising from content you unlawfully submit, your material breach of these Terms, infringement of another person's rights or unlawful misuse of NestroHub.

Suspension and termination

NestroHub may suspend, restrict or terminate access where reasonably necessary because of material or repeated breach of these Terms, suspected fraud, security threats, legal requirements, non-payment, misuse or conduct materially threatening users or platform integrity.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to address an issue.

Changes to these Terms

NestroHub may update these Terms as the marketplace, features, commercial services or legal requirements change. The current version will be published here with its last-updated date.

Where appropriate, material changes may also be communicated through the platform or another reasonable channel.

Governing law

These Terms and disputes arising out of or relating to NestroHub are governed by and construed in accordance with the laws of Sri Lanka, subject to mandatory rights or jurisdictional rules that apply and cannot lawfully be excluded.
